By accessing and using UptimeKarma ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

UptimeKarma provides uptime monitoring, security scanning, and status page services ("Service"). The Service monitors your websites, APIs, and servers for availability and performance issues, and notifies you when problems are detected.

3. User Accounts

To use the Service, you must:

  • Create an account with accurate and complete information
  • Maintain the security of your password and account
  • Promptly notify us of any unauthorized use of your account
  • Be at least 18 years old or have parental consent

You are responsible for all activities that occur under your account.

4. Subscription Plans and Billing

4.1 Plans

UptimeKarma offers multiple subscription tiers: Free, Starter, Pro, and Unlimited. Each tier has specific usage limits and features as outlined on our pricing page.

4.2 Billing

Paid subscriptions are billed monthly in advance. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

4.3 Cancellation and Refunds

You may cancel your subscription at any time. We offer a 30-day money-back guarantee for new subscriptions. Cancellations take effect at the end of the current billing period.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Monitor websites or services without proper authorization
  • Engage in any illegal or fraudulent activity
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Distribute malware, spam, or other harmful content
  • Violate any applicable laws or regulations
  • Use the Service to launch denial-of-service attacks or other malicious activities
  • Reverse engineer, decompile, or attempt to extract the source code of the Service

6. Service Availability and Limitations

While we strive to provide reliable service, we do not guarantee that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • All monitoring checks will be 100% accurate
  • Alerts will always be delivered instantly

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

7. Usage Limits

Each subscription plan has specific limits on the number of monitors, check intervals, and features. If you exceed your plan limits, we may suspend monitoring until you upgrade your plan or reduce your usage.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process data as described in our Privacy Policy to provide and improve the Service.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by UptimeKarma and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, UptimeKarma shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or the like that may be transmitted to or through our Service by any third party
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service

11. Indemnification

You agree to indemnify and hold harmless UptimeKarma, its contractors, licensors, directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which UptimeKarma operates, without regard to its conflict of law provisions.
